Terms of Service & Refund Policy

These terms are between you ("client") and the operator of Harden & Ship ("I," "me"), an independent software engineer based in Moldova (contact: upodpiscikov@gmail.com). As of this date, Harden & Ship is not yet a registered legal entity — I operate as an individual freelancer. If that changes, this page will be updated with the registered business's name and details.

1. Services

I offer three fixed-scope services, described in full on the homepage:

Timelines start once I have everything I need from you (repo access, a clear description of the issue, and the deposit). Delays in providing access push the start date back accordingly.

2. Payment

Audits and Sprints require a 50% deposit before work begins, with the remaining 50% due on delivery. Care Plan is billed monthly, in advance. Payment is accepted via Payoneer, Wise, or PayPal — no other methods are currently supported. All prices are in USD unless otherwise agreed in writing.

3. Refund Policy

If we disagree about a refund, please email me first — upodpiscikov@gmail.com — before filing a chargeback with your payment processor. Most disputes are solvable directly and faster that way.

4. What you own

The audit report and fix list are yours to keep and use however you like — with any developer, whether or not you ever book a Sprint. Code changes delivered as part of a Sprint become your property once the final payment is made. Until then, deliverables are provided for your review only.

5. Confidentiality

Your code, credentials, and any business information you share during an engagement are kept confidential. I don't reuse your code or data for other clients, publish it, or use it to train any AI model. Repo access is used only for the agreed engagement and can be revoked by you at any time.

6. No guarantee of finding everything

An Audit or Sprint is a good-faith, professional review against a defined checklist of common risks (auth, database rules, secrets, rate limiting, deploy hygiene) — it is not a guarantee that every vulnerability, bug, or edge case has been found or fixed. Software security is never absolute. I'll tell you plainly what was and wasn't in scope for a given engagement.

7. Liability

Services are provided on a best-effort, professional basis with no warranty beyond what's stated here. I'm not liable for indirect, incidental, or consequential damages arising from the use of my findings or fixes. My total liability for any claim is capped at the amount you paid me for the engagement in question.

8. Governing law

These terms are governed by the laws of Moldova, without regard to conflict-of-law principles, except where local consumer-protection law in your own country grants you rights that can't be waived by contract.

9. Changes

I may update these terms as the service evolves. Material changes will be reflected here with an updated date; changes don't apply retroactively to engagements already in progress.
